Short answer
Yes. Wisconsin follows the federal hemp definition (no more than 0.3% delta-9 THC by dry weight) and allows hemp sales to the extent federal law does. The state sets no milligram cap, no minimum age and no seller license; Milwaukee requires buyers to be 21 and Madison has its own delivery rules.[1][4][9]
Wisconsin defines hemp like the 2018 Farm Bill (delta-9-THC ≤ 0.3% dry weight, tested post-decarboxylation), lets people sell hemp 'to the greatest extent allowed under federal law,' and exempts THC contained in hemp from its controlled-substances law. The Legislative Council said in February 2026 that state law has no regulatory framework specific to hemp products beyond mislabeling prohibitions. Every 2025–26 bill that would have set an age minimum, potency caps, or licensing (AB 606/SB 681, SB 682, SB 644/AB 680) failed on March 23, 2026. Milwaukee and Madison have their own age-21 ordinances, and Madison's requires a person to check photo ID before delivery.[1][4][9]
Delta-9 THC drinks in Wisconsin: what’s allowed
- Limit per serving: No state per-serving limit (no statute or rule found; Legislative Council: no hemp-product-specific framework). Product must meet the hemp definition: ≤ 0.3% delta-9-THC on a dry weight basis (Wis. Stat. § 94.55(1)).[1][5][11]
- Limit per container or package: No state per-container limit or servings-per-container limit found. Only the 0.3% delta-9-THC dry-weight hemp definition (Wis. Stat. § 94.55(1)).[1][5][11]
- How THC is counted: Delta-9 only (post-decarboxylation, so THCA converted to delta-9 counts) — Wis. Stat. § 94.55(1)[1][5][11]
- Delta-8, THCA and other cannabinoids: Wisconsin's hemp definition covers all hemp 'derivatives, extracts, cannabinoids, isomers' within the delta-9 limit (Wis. Stat. § 94.55(1)), and THC contained in hemp is exempt from Schedule I (Wis. Stat. § 961.14(4)(t)3.). Schedule I separately lists THC 'chemically synthesized'; whether converted delta-8 or other semi-synthetic cannabinoids count as 'contained in hemp' has not been settled by any official source found. THCA counts toward the limit because testing is post-decarboxylation. Milwaukee and Madison age-21 ordinances expressly cover delta-8, delta-10, HHC, THCA, THC-O, THCP, THCV and ≤ 0.3% delta-9 products.
Age and purchase rules in Wisconsin
- Minimum age: No state minimum age (Legislative Council / failed 2025 SB 644 analysis: 'Under current law, there is no age restriction on activities related to hemp'). Local: 21 in the City of Milwaukee (Milwaukee Code § 105-50.5, effective 2025-08-02) and the City of Madison (Madison Gen. Ord. § 23.202, enacted 2025-12-03).[5][7][11]
- Where it can be sold: No state hemp retail license or channel restriction found: Wis. Stat. § 94.55(2)(a) allows selling, importing and exporting hemp 'to the greatest extent allowed under federal law.' Food and beverage products remain subject to DATCP's general food-safety, labeling and truth-in-labeling laws; under Wis. Stat. § 97.02 a food is not adulterated 'solely because it contains hemp'.[9][10][11]
- Seller licenses: No hemp-specific seller license or out-of-state seller permit found in state law. A 2019 DATCP guidance FAQ said no industrial-hemp-program license is needed to sell hemp products, but other permits (e.g., a Department of Revenue seller's permit) may apply. Whether DATCP requires a food license for an out-of-state online beverage seller was not verified.[9][10][11]
- Online sales, shipping and delivery: No state statute or rule found that bans, permits, or conditions direct-to-consumer shipping of hemp THC beverages, and no state age-verification-at-delivery rule. Local: Madison bars anyone from delivering a hemp-derived cannabinoid product without first checking the buyer's age with valid photo ID, performed by a person and 'not automated' (MGO § 23.202(2)(b)–(c)); Milwaukee bars selling or providing to anyone under 21.[13]
How the federal hemp rule affects Wisconsin
Federal law is a separate layer on top of Wisconsin law. A federal law signed November 12, 2025 rewrites the federal definition of hemp so that finished products may contain no more than 0.4 milligrams of total THC per container. A second law signed September 2, 2026 delays most of that change until December 11, 2026; until then it applies only to products made with cannabinoids the cannabis plant can’t produce naturally. Follow the dates on our federal hemp rule tracker.[F1][F2]
Pending bills and local rules in Wisconsin
- No live state bill: the 2025–26 regular session's hemp bills (AB 606/SB 681, SB 682, SB 644/AB 680) failed to pass pursuant to Senate Joint Resolution 1 on 2026-03-23. Watch the 2027 session.[5]
- Local rules: City of Milwaukee: no person may sell or provide hemp-derived cannabinoids (including ≤ 0.3% delta-9 products) to anyone under 21; forfeiture $400–$1,000 (Code § 105-50.5, effective 2025-08-02). City of Madison (MGO § 23.202, enacted 2025-12-03): age 21; nobody may deliver or provide a product without first checking the buyer's age against valid government photo ID, done by a person and not automated; plus signs, behind-counter display (beverages may stay in coolers), no vending machines, and a quarter-mile buffer from youth-serving locations. Other municipalities may have their own ordinances; only these two were checked.
