Short answer
Effectively no. Since August 15, 2026, no hemp product sold at retail in Virginia may contain more than 2 mg total THC per package, which rules out typical THC drinks. Retail sellers also need a regulated hemp product registration for each location.[2][3][8]
Since August 15, 2026, no hemp product sold at retail in Virginia may contain more than 2 mg total THC per package (the old 25:1 CBD-ratio exception was repealed), so intoxicating hemp THC drinks are effectively banned; a product over the limit 'may be considered marijuana.' Products at or under 2 mg per package may be sold only from a registered retail location, to adults 21+, and Virginia's licensed adult-use marijuana sales do not start until July 1, 2027.[2][3][8]
Delta-9 THC drinks in Virginia: what’s allowed
- Limit per serving: No separate per-serving cap; the binding limit is per package (labels must state mg total THC per serving).[1][2][8]
- Limit per container or package: 2 mg total THC per package, and no more than 0.3% total THC concentration (Va. Code §3.2-5145.4 as effective Aug 15, 2026; §3.2-4126(B)). The 25:1 CBD-to-THC exception was repealed Aug 15, 2026; no sell-through period.[1][2][8]
- How THC is counted: total THC[1][2][8]
- Delta-8, THCA and other cannabinoids: The limit is total THC (Delta-9 + all Delta-9 isomers + 0.877 x THCA per the CCA), so Delta-8 and THCA count toward the 2 mg cap. Selling any ingestible or inhalable substance containing a 'synthetic derivative' of THC is a prohibited practice under the Virginia Consumer Protection Act (§59.1-200(A)(69)).[6][9]
Age and purchase rules in Virginia
- Minimum age: 21 (Va. Code §59.1-200(A)(70); labels must say the product may not be sold to persons younger than 21, §3.2-4123(A)(2))[3][6][7]
- Where it can be sold: Retail sale of a regulated (edible or inhalable) hemp product requires a regulated hemp product retail facility registration for each physical location ($1,000/yr; Va. Code §3.2-4122), now administered by the Virginia Cannabis Control Authority (CCA). Manufacturers of edible hemp products need a VDACS food permit (§3.2-5100). From July 1, 2027 the registration moves to Va. Code §4.1-1700 (same terms). Licensed marijuana retail stores open July 1, 2027.[1][3][8]
- Seller licenses: Regulated hemp product retail facility registration (§3.2-4122): the application must give 'the physical address of the facility', and a registration authorizes sales 'only at the location specified in the registration.' No registration path for out-of-state or online-only sellers was found. Selling without one carries a civil penalty up to $10,000 per day (§3.2-4126(B)).[1][3][8]
- Online sales, shipping and delivery: No Virginia statute found that expressly authorizes or regulates mail/internet sales of edible hemp products (the mail-order age-verification rule in §18.2-371.2 covers only hemp products intended for smoking).[7]
How the federal hemp rule affects Virginia
Federal law is a separate layer on top of Virginia law. A federal law signed November 12, 2025 rewrites the federal definition of hemp so that finished products may contain no more than 0.4 milligrams of total THC per container. A second law signed September 2, 2026 delays most of that change until December 11, 2026; until then it applies only to products made with cannabinoids the cannabis plant can’t produce naturally. Follow the dates on our federal hemp rule tracker.[F1][F2]
Pending bills and local rules in Virginia
- CCA is writing regulations and a licensing process for the retail marijuana market that opens July 1, 2027 (the licensed channel in which higher-THC products would be sold)[10]
- Local rules: No official local hemp-product restrictions found; the limits are statewide.
