Short answer
Unclear. South Dakota has no drink-specific hemp rules, but since 2024 it bans selling hemp products containing chemically derived or converted cannabinoids, and a 2025 Attorney General opinion says most hemp-derived THC products are illegal to sell.[1][4][8]
South Dakota has no beverage-specific hemp THC rules, but since 2024 it has banned selling hemp products containing 'chemically derived cannabinoids' or cannabinoids created by chemically modifying or converting hemp extract (SDCL 34-20B-118). The Attorney General's Official Opinion 25-04 (Nov 3, 2025) says most hemp-derived THC on the market is made by chemical conversion or extraction and is therefore illegal to sell to anyone, and that whether a given THC beverage is legal cannot be answered without a reputable lab report. A 2026 bill to ban hemp-derived intoxicants outright failed in the Senate.[1][4][8]
Delta-9 THC drinks in South Dakota: what’s allowed
- Limit per serving: No per-serving limit found in SDCL ch. 38-35 or 34-20B.
- Limit per container or package: No per-container limit found; hemp must be no more than 0.3% total Delta-9 THC on a dry weight basis (SDCL 38-35-1).
- How THC is counted: Delta-9 only
- Delta-8, THCA and other cannabinoids: Selling hemp products with chemically derived cannabinoids or cannabinoids made by chemically modifying or converting hemp extract is a Class 2 misdemeanor, as is converting CBD into Delta-8/9/10 (SDCL 34-20B-118). 'Industrial hemp product' excludes Delta-8, Delta-10, THC-O, HHC and THCP (SDCL 38-35-1). Hemp for smoking is banned (SDCL 38-35-21). Selling Delta-8, THCA, THC-O or HHC products to under-21s is a Class 1 misdemeanor (SDCL 34-20B-117).[1][4]
Age and purchase rules in South Dakota
- Minimum age: No statutory minimum age for Delta-9 THC hemp beverages was found. 21 for products containing Delta-8 THC, THCA, THC-O acetate, or HHC (SDCL 34-20B-117, as amended by 2026 SB 45).
- Where it can be sold: No state retail license or channel restriction for hemp products found; the legality question is about how the THC was made (SDCL 34-20B-118) rather than who sells it.[1][4][8]
- Seller licenses: No state retail registration for hemp-derived consumer products found. The state hemp grower/processor program is repealed effective Jan 1, 2027 in favor of federal (USDA) regulation (2026 SB 39).[1][4][8]
- Online sales, shipping and delivery: No South Dakota statute or agency page addressing online sale or direct shipping of hemp THC products to consumers was found (searched SDCL 38-35 and 34-20B and the AG opinion). The sale ban in SDCL 34-20B-118 applies regardless of channel.
How the federal hemp rule affects South Dakota
Federal law is a separate layer on top of South Dakota law. A federal law signed November 12, 2025 rewrites the federal definition of hemp so that finished products may contain no more than 0.4 milligrams of total THC per container. A second law signed September 2, 2026 delays most of that change until December 11, 2026; until then it applies only to products made with cannabinoids the cannabis plant can’t produce naturally. Follow the dates on our federal hemp rule tracker.[F1][F2]
Pending bills and local rules in South Dakota

- South Dakota Legislature — watch the 2027 session for renewed hemp-intoxicant bills (2026 SB 61 failed)
