Short answer
No. Idaho keeps tetrahydrocannabinols in Schedule I, and the state Department of Agriculture reads the hemp exception to allow no THC at all in manufactured hemp products. Idaho has no marijuana dispensary channel.[1][2][7]
Idaho lists tetrahydrocannabinols in Schedule I, except for 'the permitted amount of tetrahydrocannabinol found in industrial hemp' (Idaho Code 37-2705(d)(29)(i)). The Idaho State Department of Agriculture (ISDA) reads this to mean THC is illegal in every manufactured hemp product, hemp-derived beverages included. Its FAQ, updated Aug 28, 2026, says only hulled hemp seed, hemp seed protein powder and hemp seed oil may be used in food. The Office of Drug Policy says retail products must contain zero percent THC. H0879 (2026 Sess. Laws ch. 292, effective July 1, 2026) put establishments offering ingestible or inhalable hemp products under the Industrial Hemp Research and Development Act. It requires those products to meet 37-2701(u) and 37-2705(d)(29)(i) but sets no THC allowance of its own, and ISDA's FAQ still applies a 0.0% THC standard. Idaho has no medical or adult-use marijuana program, so there is no licensed THC channel.[1][2][7]
Delta-9 THC drinks in Idaho: what’s allowed
- Limit per serving: None allowed: ISDA treats any THC in a manufactured hemp product as illegal (0.0% THC). There is no per-serving allowance.[1][7][9]
- Limit per container or package: None allowed: 0.0% THC in manufactured or retail hemp products (ISDA FAQ; Office of Drug Policy).[1][7][9]
- How THC is counted: total THC[1][7][9]
- Delta-8, THCA and other cannabinoids: Schedule I covers tetrahydrocannabinols generally, including Delta-1 (Delta-9) cis/trans, Delta-6 cis/trans, Delta-3,4 and their isomers, plus synthetic equivalents and derivatives 'with similar chemical structure' (Idaho Code 37-2705(d)(29)). The only exception is the permitted amount found in industrial hemp or FDA-approved drugs. Delta-8 and other THC isomers therefore fall under the Schedule I THC listing; no Idaho provision specific to Delta-8 was confirmed. CBD is lawful only with zero percent THC (ISDA FAQ).[1][2]
Age and purchase rules in Idaho
- Minimum age: Not verified. No hemp-specific minimum age was found in Idaho Code 22-1705, 37-2701, or the ISDA FAQ. The question is moot because THC products are barred.
- Where it can be sold: None for THC products. ISDA allows only zero-THC hemp products, plus hulled hemp seed, hemp seed protein powder and hemp seed oil in food. Idaho has no marijuana dispensary channel.[2][7][9]
- Seller licenses: From July 1, 2026, establishments offering hemp products for human ingestion or inhalation are 'subject to the provisions of' the Industrial Hemp Research and Development Act (Idaho Code 22-1705(4)), and ISDA may set fees and penalties by rule (22-1705(5)). The ISDA FAQ still says 'ISDA is not requiring licenses for retailers.' No retailer rule or fee had been adopted as of the check date.[2][7][9]
- Online sales, shipping and delivery: Not verified. No Idaho provision specifically about direct-to-consumer shipping of hemp products was found. Shipping THC-containing products into Idaho would place products with more than 0% THC in the Idaho marketplace, which ISDA and the Office of Drug Policy say is illegal and 'subject to law enforcement.' Idaho Code 67-2921 covers interstate transport of hemp; its exemption for hemp-derived products applies only to products with 'no quantity' of Delta-9 THC.
How the federal hemp rule affects Idaho
Federal law is a separate layer on top of Idaho law. A federal law signed November 12, 2025 rewrites the federal definition of hemp so that finished products may contain no more than 0.4 milligrams of total THC per container. A second law signed September 2, 2026 delays most of that change until December 11, 2026; until then it applies only to products made with cannabinoids the cannabis plant can’t produce naturally. Follow the dates on our federal hemp rule tracker.[F1][F2]
Pending bills and local rules in Idaho
- ISDA negotiated rulemaking on fees and penalties for retailers of ingestible or inhalable hemp under Idaho Code 22-1705(4)-(5) and (7)(a), as added by H0879 (2026). No rule was found as of the check date. The fiscal note says any fee must be approved by the legislature.[5]
- Local rules: None found. THC is a statewide Schedule I substance, enforced by state and local law enforcement.
